Terms and Conditions
In the following document, the terms and conditions regarding the use of the service provided on RealBitcoinShop.com, referred to as RBS, by a person, referred to as the customer, are described. To make use of any service provided by RBS, or by purchasing anything in the webshop of RBS, this document has to be accepted by the customer. RBS assumes the customer has read and understood all terms and conditions in this document.
1. Liability Limitation
RBS does not guarantee, represent, or warrant that your use of the service, meaning the online webshop or the Token program, will be uninterrupted or error-free. The service may be switched off at any time, without notice beforehand. The use of, or inability to use, the service is at sole risk of the user. The service and all products and services delivered to you through the URL of RBS, are provided “as is” and “as available” for your use, without warranties of any kind, either express or implied, including all implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. Because some jurisdictions do not allow the exclusion of implied warranties, the above exclusion of implied warranties may not apply to you. In no event shall the total liability of RBS for damages, losses and causes of action (whether in contract or tort, including, but not limited to, negligence or otherwise) arising from the use of the customer.
2. Third Party Service
RBS collaborates with many third parties to provide the service as it is. Any general errors or failures of the service, as a result of shortcomings from third party services, may result in dysfunctionality of the ability from RBS to comply with initial commitments. RBS does not accept any liability in losses of functionality, standing amounts or pending transactions or orders at the failure of third party services, provided that any complaints originate from such errors. Guarantees as described in this agreements will stay in effect, unless any complaints are the direct result of third party failure.
3. The Product
By buying products on RBS, the buyer agrees to the limits of the product, which extend to the abilities of a physical object without applications. The product offered by RBS can be categorized as commemorative coins. The name of the product frequently indicates a reference to the cryptocurrency, but does not signify to have technological properties at all, on or off the blockchain. The value of the product, after purchase, is not guaranteed. The product, although it is a coin, is not a real currency and can not be expected to be accepted as such by anyone. The product does not carry the value of the represented actual coin. To provide an example; the product ‘Bitcoin (BTC)’, does not hold the value of an actual Bitcoin with blockchain properties. The same applies to all other possible combinations. All products made of metal, are not made of precious metals. Some products are supplemented by plastic components. When these components break during logistics, RBS can not be hold accountable. When a product consists of a plastic object, the buyer may expect to acquire it in complete condition. If such a product is broken, the normal return policies, as described in these terms and conditions, can be applied.
RBS only processes transactions that are authorized by the relevant intermediary (intermediaries) and/or the financial institution involved in the specific payment method and /or customer. In each transaction, there will be a contractual relationship between RBS and the customer on the one hand and the customer and a (relevant) financial institution on the other. RBS gives no guarantees and accepts no liability for transactions that are automated and completed, but which at a later stage, in whatever form, are reversed by the customer or the financial institution. Refunds may the cause of, but not limited to, the following examples; 1. A dispute with the customer. 2. Unauthorized or incorrectly authorized transactions. 3. Transactions that do not comply with the rules of the relevant transaction-processing network of the card-issuing agency involved in this agreement, or which are allegedly unlawful or suspicious. 4. Any other reason used by one of the relevant financial institutions or cardholders card-issuing institution. Any issue regarding the payments, can fall under the agreement of third party service, be it in reasonable extent.
The time of delivery may very greatly depending on demographics and/or logistical causes. RBS expects to process all products worldwide within 21 days, but can’t guarantee all cases. Each shipment can fall under the agreement of third party service, be it in reasonable extent.
Customers may request refunds if the product(s) are falling in one of the following categories; 1. Broken or incomplete. 2. Not being delivered. The first category requires initiative from the customer to make contact first. RBS may in turn request visual evidence of the complaint, along with the receipt or other relevant information. By failure of the customer to meet these requests, RBS is allowed to settle requests for refunds as invalid and therefore not comply with the customers demands. As for the second category, customers are obliged to fill in a request for their refund within the broad period of twenty-one days, taking effect from the date of purchase. Here too, RBS may request for the customer providing evidence or additional information before proceeding the procedure. RBS holds the legitimate position to disapprove any request of refunds by the customer based on suspicions of falseness of the complaint, negligence of the customer or not complying to the rules of the agreement. RBS is not required to take back any products for any reason.
7. Token Program
The Token program, offered as a service on RBS, allows the customer to save points, called Tokens, for purchases of products and services provided by RBS, as offered in the webshop. The points accumulated by the customer have no actual value beyond these limits. It is not possible for anyone to redeem these points for anything but products and services offered by RBS. The customer is unable to exchange these points with others, including but not limited to RBS, outside the functional properties of the software provided by the relevant third-party provider. Any issue regarding the Token program, can fall under the agreement of third party service, be it in reasonable extent. Anyone having any number of points, doesn’t have actual possession over them. RBS may legitimately decide to switch-off the service at any time, or even decide to shut down the service completely, without prior warning. The customer is not entitled to any compensation, should these situations occur.
